Terms of Service

Effective date: 21 May 2026

These Terms of Service ("Terms") govern your access to and use of the GeoSphere website and elevation API (collectively, the "Service"), operated by GeoSphere ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service you confirm that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and API keys. You must notify us immediately at support@geosphere.info if you suspect any unauthorised access to your account. We are not liable for any loss arising from your failure to keep your credentials secure.

You may not share your account, transfer it to another person, or create multiple accounts to circumvent usage limits or access free trials more than once.

3. Free Trial

We may offer a free trial that provides a limited number of API requests for a defined period. Each user is entitled to one free trial. We reserve the right to modify or withdraw the free trial offer at any time. The trial automatically ends when the request limit or time period is reached, whichever occurs first. No payment method is required to start a trial.

4. Subscriptions and Billing

Monthly subscriptions are billed in advance on a recurring basis. By subscribing, you authorise us to charge your payment method each month until you cancel. All prices are in US dollars (USD) and are exclusive of any applicable taxes, which are your responsibility.

Minimum commitment period: Monthly subscriptions carry a minimum commitment period of three (3) months. If you request cancellation before the end of this period, your subscription will remain active and billing will continue until the commitment period ends. After that, no further charges will be made and your access will end at the close of the paid period.

If a payment fails, we will attempt to collect payment again. Continued failure to pay may result in suspension or termination of your account.

5. One-Time Purchases

One-time purchases provide access to a fixed number of API requests for a defined validity period (typically 30 days from the date of purchase). Unused requests do not roll over after the validity period expires. One-time purchases are non-transferable.

6. Refund Policy

All payments are non-refundable except at our sole discretion. If you believe a charge was made in error, please contact us at support@geosphere.info within 14 days of the charge and we will review your case. Granting a refund does not obligate us to grant refunds in future circumstances.

7. API Usage and Quotas

Your subscription or purchase entitles you to a defined number of API requests per billing period. Unused quota does not carry over between billing periods for monthly subscriptions. We reserve the right to enforce rate limits and throttle requests to protect service stability.

You must not attempt to circumvent quotas, resell API access, use the Service to build a competing product, or use the API in any way that disrupts or degrades service for other users.

8. API Keys

API keys issued to your account are for your use only. You are responsible for all API requests made using your keys. Do not embed API keys in public repositories or client-side code. We reserve the right to revoke any API key that we reasonably believe has been compromised or is being misused.

9. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of any third party
  • Transmit malicious code or interfere with the integrity of the Service
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Resell or sublicense access to the API without our written consent
  • Use the Service for any unlawful, fraudulent, or harmful purpose

We reserve the right to suspend or terminate accounts that we believe are in breach of these rules, without prior notice where we consider it necessary.

10. Intellectual Property

The Service, including its software, design, and content, is owned by GeoSphere and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described here.

11. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted or error-free access. The Service is provided "as is" without warranty of any kind. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. Where reasonably practicable we will notify users of planned maintenance in advance.

12. Limitation of Liability

To the fullest extent permitted by UK law, GeoSphere shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of profits, data, or business opportunities.

Our total aggregate liability to you in connection with these Terms shall not exceed the greater of (a) the total amount you paid us in the 3 months preceding the event giving rise to the claim, or (b) £100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Termination

You may delete your account at any time by contacting us at support@geosphere.info. Termination does not entitle you to a refund of any prepaid fees. We may suspend or terminate your account at any time for breach of these Terms, non-payment, or at our discretion with reasonable notice.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
